Issued under authority of the Department of the Army and Office of the Provost Marshal General

The following articles constitute the standing criminal and disciplinary law governing members of the New California Republic Armed Forces. The purpose of military justice is to maintain discipline, protect the Republic and its citizens, and ensure that military authority is exercised lawfully.

Unless specifically stated otherwise, this Code applies to all active-duty soldiers, Rangers attached to military command, military medical personnel, reservists while activated, and other persons formally placed under NCRA military jurisdiction.

TITLE I - General Provisions

Article 1 - Lawful Authority

All personnel shall obey lawful orders issued by officers, non-commissioned officers, Provost personnel, or other authorities empowered by NCR law.

An order requiring an individual to knowingly commit an unlawful act is not a lawful order.

Article 2 - Responsibility

Rank does not excuse criminal conduct.

Personnel issuing an unlawful order may be charged for the offense committed under that order in addition to Abuse of Authority.

Personnel carrying out an obviously unlawful order may likewise be held responsible.

Article 3 - Attempt, Conspiracy, and Assistance

Attempting to commit an offense, knowingly assisting in its commission, or conspiring with another person to commit it may be punished as the underlying offense.

Article 4 - Command Responsibility

Command personnel who knowingly permit serious criminal conduct by their subordinates and take no reasonable action to prevent, stop, or report it may be subject to disciplinary action.

TITLE II - Offenses agains military discipline

Article 10 - Failure to Obey an Order

Knowingly failing or refusing to comply with a lawful order.

Classification: Minor to Serious Offense Maximum Punishment: 30 minutes confinement, reduction in rank, suspension, or discharge.
